CONSTRUCTION CONTRACTS UNDER FIDIC RULES

EU PPF8 team hosted another training on Basics of FIDIC Conditions of Contract in Belgrade, that was successfully completed by 10 representatives of the Ministry of Finance – Department for Contracting and Financing of European Union Funded programs, Ministry of European Integration and Ministry of Environmental Protection.

The objective of this training was to enhance the participants’ knowledge and understanding of the procurement procedures, forms and content of standard FIDIC contracts in construction as well as its relation with the national Law of Contract and Torts. The trainers of the EU PPF8 team emphasized the general principles and main contracting differences between the FIDIC 1999 Yellow and Red Book. In addition, the participants also had an opportunity to exercise preparation of Appendix to an offer.

Knowledge of international tender procedures and legal issues is of crucial importance for successful implementation of large infrastructure projects. FIDIC (Fédération Internationale Des Ingénieurs-Conseils) was founded in 1913 after the “First International Congress of Consulting Engineers and Expert Engineers” and it is most frequently used set of conditions of contract in international construction and engineering. The use of FIDIC Conditions of Contract is a recommendation of the World Bank, Inter-American Development Bank, UN Industrial Development Organisation, leading international commercial banks and investment funds, as well as other capital investors.
